ORAL ORDER

1. The applicant has filed note for speaking to minutes pointing out a mistake crept in order dated 05.02.2026 passed in Special Civil Application No. 16839 of 2025 with Special Civil Application No.

17418 of 2025. The paragraph no. 7:

“In light of the aforesaid affidavit filed by private respondents herein and considering the statement made by Mr.Parikh, learned Assistant Government Pleader, and with the consent of the learned advocates appearing for the respective parties, in the interest of justice, the impugned orders dated 21.01.2019 / 02.02.2019 passed by the Learned Special Secretary (Appeals) Revenue Department in Revision Application No.MVV/BKHP/Kutch/2/2018 are quashed and set aside.”

is directed to be replaced with:

"In light of the aforesaid affidavit filed by private respondents herein and considering the statement made by Mr. Parikh, learned Assistant Government Pleader, and with the consent of the learned advocates appearing for the respective parties, in the interest of justice, the impugned order dated 24.01.2019/02.02.2019 passed by the Learned Special Secretary (Appeals), Revenue Department in Revision Application No. MVV/BKHP/Kutch/2/2018 and the order dated 26.08.2022 passed by the Deputy Collector, Bhachau in Case No. 122/2020 are hereby quashed and set aside. Consequently, the Non-Agricultural Permission dated 15.01.2010 and the consolidation order dated 07.03.2008 stand restored.”

2. Office is directed to carry out the above correction in order dated 05.02.2026 passed in Special Civil Application No. 16839 of 2025 with Special Civil Application No. 17418 of 2025. Accordingly, this note for speaking to minutes stands allowed.

2.1 The petitioners herein purchased the land in question by way of registered sale-deed dated 21.03.2007 originally land bearing survey no.852/2 of Mouje: Juna Katariya, Tal.Bhachau, Dist.Kachchh belonging to one Thakkar Rambhiben Govindji. The said land was purchased by Bachubhai Sukabhai Antroliya by registered sale-deed on 02.03.2000 for which entry is mutated in the revenue record being Entry No.1695. The said land was further so
