IA ORDER

1. Rule returnable forthwith. Learned APP waives service of notice of Rule on behalf of respondent-State.

2. Present application is filed by the applicant with a prayer to modification/deletion of condition no. 6(e) imposed vide order dated 24.01.2014 passed in CRMA No. 16863 of 2013 which reads as under :

6(e) will not leave India without the permission of the Court and, if is holding a Passport, shall surrender the same before the trial Court immediately.

3. Learned advocate for the applicant submitted that, the aforesaid condition is causing hindrance to him while visiting outside India for the purpose of business, as the applicant is involved in such business which requires considerable travel.

3.1 In support of aforesaid submission, learned advocate produced relevant documentary evidences.

4. Heard learned advocate for the applicant, learned APP for the respondent-State as well as perused the documentary evidences produced on record.

5. In view of the aforesaid, it appears that the present applicant requires consideration.

6. Hence, condition no. 6(e) imposed vide order dated 24.01.2014 passed in CRMA No. 16863 of 2013 is kept in abeyance for a period of two years, subject to following conditions:-

i. The applicant shall deposit an amount of Rs. 10,00,000/- before the learned Trial Court within a period of 15 days from today and whereas, upon the said amount being deposited with the learned Trial Court, the above condition 6(e) of the order dated 24.01.2014 shall be treated as to have been kept in abeyance for a period of two years.

ii. The applicant shall intimate to the learned Trial Court as and when he intends to travel outside India and a detailed specific itinerary along with local addresses and mobile numbers shall be submitted to the learned Trial Court. The applicant is directed to adhere strictly to the itinerary.

iii. The applicant shall also tender his e-mail ID and mobile numbers to the learned Trial Court, and in case his presence is required at the stage of the trial, any intimation, calling the applicant to return, shall be adhered to strictly, even if it is in the middle of the itinerary submitted by the applicant.

iv. In case the applicant violates any of the above conditions or any of the bail condition, the amount of Rs. 10,00,000/- deposited by the applicant shall be forfeitted by the learned Trial Court albeit, after giving appropriate opportunity to the present petitioner to put up his submissions.

v. In case the aforesaid conditions are strictly fulfilled, at the end of the period of two years, the amount of Rs. 10,00,000/- deposited by the applicant shall be refunded to him, without any further order from this Court.

vi. Further, neither the applicant nor the applicant’s advocate before the trial court shall pray for adjournment stating the absence of the applicant.

7. With the above direction, the present application stand disposed of. Rule is made absolute to the aforesaid extent.
