1. Issue RULE, returnable forthwith. Mr. G.H. Virk, learned Government Pleader waives service of Rule on behalf of the respondent – State. With the consent of the learned advocates appearing for the respective parties, the matter is taken up for final hearing.
1.1. Heard Mr. R.S. Sanjanwala, learned Senior Counsel assisted by Mr. Aadit R. Sanjanwala, learned advocate appearing for the petitioner and Mr. G.H. Virk, learned Government Pleader assisted by Ms. Dharitri Pancholi, learned Assistant Government Pleader appearing for the respondent – State authorities.
2. By way of the present petition, the petitioner herein has invoked Article- 226 and 227 of the Constitution of India, challenging the order dated 18.07.2025 by the Gujarat Revenue Tribunal (hereinafter referred to as ‘the GRT’) dismissing the Appeal being No. Appeal/AMD/83/2025 (Annexure-B collectively), confirming the order dated 04.04.2025 passed by the City Deputy Collector (West) Ahmedabad in Sharatbhang/Case No. 7/2023 (Annexure-B collectively) ordering forfeiture of the lands of Sant Shri Asharam Ashram (hereinafter referred to as ‘the Ashram’ for short) on the purported grounds of breach of conditions of the orders of grant, having prayed for the following reliefs:
“8. The Petitioner prays that:
(a) The Hon’ble Court may be pleased to quash and set aside the order dated 18.07.2025 passed by Gujarat Revenue Tribunal in Appeal/AMD/83/2025 (Annexure B Colly);
(b) Pending hearing and final disposal of this petition/Application, this Hon'ble Court may be pleased to stay operation, implementation and execution of the order dated 18.07.2025 passed by Gujarat Revenue Tribunal in Appeal/AMD/83/2025 (Annexure B Colly)
(c) Pending hearing and final disposal of this petition/Application, this Hon'ble Court may be pleased to stay operation, implementation and execution of the order dated 04/04/2025 passed by City Deputy Collector (West) Ahmedabad in Sharatbhang/Case No.7/2023; at Annexure-B Colly.
(d) Pending the hearing and final disposal of this petition, the Hon’ble Court may be pleased to direct the respondents authorities to maintain status quo and not take any coercive measures to takeover possession of the Petitioner’s Ashram land;
(e) Interim and Ad-interim relief in terms of prayer clause (b) to (d) above;
(f) For such other and further reliefs that the Hon’ble Court deems fit in the interest of justice.”
3. The brief facts leading to the filing of the present Petition reads thus:
3.1. The petitioner is a registered public charitable Trust under the provisions of the Gujarat Public Trusts Act, 1950 bearing registration No.E/2345, undertaking the charitable, educational and spiritual activities in accordance with the objectives mentioned in the constitution. The objectives of the trust are to cultivate spiritual faith in people, give spiritual education, uplift and enlighten people, educate people on mental and physical well-being through Ayurveda, cultivate harmony and friendship in different communities, educate people on Indian culture and tradition, to develop patriotism, educate the weaker section of the society, etc.
