IA ORDER
RULE. Learned APP appears and waives service of notice of rule on behalf of the respondent-State.
1. The applicant has preferred this application seeking for a period of 30 days on the ground of attending the marriage of his niece which is scheduled to be conducted from 06.02.2026 till 10.02.2026.
2. Heard learned advocate Mr. Sumit K. Prajapti for the applicant and learned APP Ms. C.M. Shah for the respondent No. 1 and perused the jail remarks on record.
3. Learned advocate for the applicant submits that the marriage of the niece of the present applicant is scheduled from 06.02.2026 till 10.02.2026, therefore, the presence of the applicant is necessary and hence, has urged this Court to allow the application for temporary bail and release the applicant for a period of 30 days.
4. Learned APP has submitted that as per the jail remarks, the applicant has been convicted for a period of 10 years and fine of Rs.20,000/- and in default one year imprisonment for the offences punishable under Sections 363, 366 and 376 of Indian Penal Code by the judgment and order dated 24.08.2022 and has urged this Court to reject the application.
5. Considering the submissions and on perusal of the jail remarks, the application requires consideration and the same is allowed. The applicant shall be released on temporary bail for a period of FOUR DAYS from 08.02.2026 to 11.02.2026 from the date of his actual release on usual terms and conditions and on executing of personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the concerned Jail authority. The applicant shall surrender before the Jail Authority on completion of temporary bail period, without fail.
6. Registry is directed to communicate this order to the concerned Jail Authority by fax / email message forthwith.
Rule is made absolute.
