Taking note of the facts and circumstances of the

present matter, the explanation of the delay of 221 days in filing the appeal is found to be sufficient, the delay condonation application is hereby allowed. The delay in filing

the appeal is condoned.

This intra-court appeal is directed against the judgment

and order dated 25.06.2025 passed by the Writ Court, issuing directions to the respondent authorities to add the names of the college namely the respondent herein in the list of colleges mentioned in the advertisement as available on the website of the respondent authorities for allotment of students in (D.El.Ed.) course and considered the case of the petitioners vide application dated 10.06.2025 for allotment of students in

(D.El.Ed.) course for the academic year 2025-26.

It is categorically stated in the memo of the appeal that

the writ petition has been filed by the concealment of the material fact that the recognition/permission granted to the respondent – institute for conducting PTC Course (D.El.Ed.) intake of 50 had been withdrawn by the National Council for Teacher Education (NCTE) vide order dated 06.03.2013, pursuant to a request made by the institution for withdrawal of their recognition from the end of the academic session next to the date of issue of withdrawal order. Copy of the withdrawal order of NCTE is appended at page no. 53 of the

paper-book.

Taking note of the above, we permit Ms. Hetal Patel, the

learned Assistant Government Pleader appearing for the State – appellants to implead the National Council for Teacher Education (NCTE) in a proper manner as the respondent no. 2 in the present appeal. Ms. Hetal Patel, learned advocate would also submit that she has received instructions from the NCTE to intervene in this matter. A vakalatnama on behalf of the NCTE shall be filed on the next date fixed and the instructions in writing or an affidavit on the order of the withdrawal dated 06.03.2013 shall be placed/filed before the

Court on the next date fixed.

Ms. Komal Dave, learned advocate has put in

appearance on behalf of the respondent no. 1 – institution. She may file her affidavit by the next date fixed. Post the
