ORAL ORDER
1. Heard learned advocate Mr.Jayraj Dani for learned advocate Mr.V.A.Zala appearing on behalf of the applicant and learned Additional Public Prosecutor Ms.Vrunda Shah appearing on behalf of the respondent-State.
2. Rule. Learned APP waives service of rule on behalf of the respondent-State.
3. By way of this application, the applicant seeks for modification of condition no.3 of order dated 09.07.2024 passed in Criminal Misc. Application No.672/2024 whereby the applicant had been enlarged on regular bail. The condition being that the applicant is required to deposit his passport with the learned Trial Court.
4. Considering the submissions made by learned advocate for the applicant, it appears that the applicant has diligently deposited his passport and whereas, attention of this Court is drawn on the details of the passport which would show that the passport would expire on 29.08.2026.
5. While learned advocate would submit that the present applicant, after renewal of the passport, may be permitted to retain his passport, this Court is not inclined to consider such a request at this stage and whereas, to this Court, it would appear that as of now, the present applicant may be permitted to renew his passport and whereas, as and when any occasion arises for the applicant to travel abroad, the same would be treated as a fresh cause of action and whereas, liberty is reserved in favour of the applicant to approach learned Sessions Court with an appropriate application for the same.
6. Having regard to the above, following directions are passed:-
(i) The learned Trial Court shall, upon an application being made by the applicant, release the passport of the applicant for the purpose of renewal only.
(ii) Upon the passport being renewed, the applicant shall redeposit the same with the learned Trial Court within a period of seven days from the date of receipt of the same.
(iii) It is clarified at the cost of repetition that release of passport as of now would not be treated as a permission for the applicant to travel abroad.
(iv) It is clarified that in case after the passport is renewed the present applicant is required to travel abroad, then the present applicant is at liberty to file fresh application which shall be considered on its own merits by the learned Trial Court.
7. With the above, present application stands disposed of. Rule is made absolute to the aforesaid extent. Direct service is permitted.
