1. Heard Mr. Percy Kavina, learned Senior Counsel assisted by Mr. Kuldeep K. Adesara, learned advocate appearing for the petitioner, Mr. Riddhesh Trivedi, learned advocate appearing for the respondent No.2, Mr. Chinmay M. Gandhi, learned advocate appearing for the respondent No.3, Mr. M.K. Vakharia, learned advocate appearing for the respondent No.4 and Mr. Jayneel Parikh, learned Assistant Government Pleader appearing for the respondent No.1 – State.

2. The facts involved in both the captioned petitions are selfsame. For the sake of convenience, the Special Civil Application No.9060 of 2025 is treated as the lead matter.

3. By way of Special Civil Application No.9060 of 2025, the petitioner has prayed for the following reliefs:

“24. In view of what is stated herein above, it is prayed by present petitioners to:

(a) Admit/allow this writ petition;

(b) issue a writ of certiorari or any other appropriate writ, order or direction quashing and setting aside impugned order dated 20.12.2022 passed by Collector, Ahmedabad in Order No.7137/07/17/056/2022.

Annx.= ‘O’

(c) During admission, hearing and final disposal of above captioned Special Civil Application, stay implementation and execution of order dated 20.12.2022 passed by Collector, Ahmedabad in Order No.7137/07/17/056/2022 and further be pleased to order maintenance of status quo qua subject land. Annex=O (d) any other and further relief as deem fit in the interest of justice may kindly be passed.”

4. By way of Special Civil Application No.9226 of 2025, the petitioner has prayed for the following reliefs:

“24. In view of what is stated herein above, it is prayed by present petitioners to:

(a) Admit/allow this writ petition;

(b) issue a writ of certiorari or any other appropriate writ, order or direction quashing and setting aside impugned order dated 15.12.2022 passed by Collector, Ahmedabad in Order No.6953/07/17/056/2022.

(c) During admission, hearing and final disposal of above captioned Special Civil Application, stay implementation and execution of order dated 15.12.2022 passed by Collector, Ahmedabad in Order No.6953/07/17/056/2022 Annex=N and further be pleased to order maintenance of status quo qua subject land.

(d) any other and further relief as deem fit in the interest of justice may kindly be passed.”

5. The petitioner has challenged the order dated 15.12.2022 being Order No.6953/07/17/056/2022 passed by the Collector, Ahmedabad, removing the restrictions under Section 43 of the Tenancy Act, by preferring Special Civil Application No.9226 of

2025.

5.1 The petitioner has challenged the order of grant of Non- Agriculture (NA) permission to the private respondents herein passed by the Collector, Ahmedabad, being Order No.7137/07/17/056/2022, dated 20.12.2022 duly produced at Annexure – O by preferring Special Civil Application No.9060 of
