ORAL ORDER
1. Heard learned advocate Mr. Aaditya D. Bhatt appearing on behalf of the applicant, learned Additional Public Prosecutor Mr. Niraj Sharma appearing on behalf of the respondent-State and learned advocate Mr. Ankit Shah with learned advocate Ms. Zeel Raval for the respondent No.2.
2. Rule. Learned APP waives service of rule on behalf of the respondent-State.
3. The applicant has filed this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for enlarging the applicant on Regular Bail in connection with FIR being NCB/AZU/CR-07/2023 registered with Central Bureau of Narcotics, New Delhi, for the offence punishable under Sections 8, 21, 22, 29 read with Section 35 of Narcotics Drugs and Psychotropic Substances Act, 1985.
4. Learned advocate Mr. Bhatt for the applicant has inter alia argued that the applicant being a license holder, entitled to deal in the products in question, upon orders being received, had dispatched the order to other license holder and whereas it appears that some of the orders were by co-
0.6381237077317784 accused, who had given licenses of other parties and not by the license holder and whereas it is on basis of such transaction that the complaint alleging the offences has been filed against the applicant. Learned advocate would submit that as such, the applicant was conducting completely legal and bona fide business and whereas upon the co-accused sending him licenses, the applicant had bona fidely dispatched the goods in question and whereas learned advocate would submit that as such, even the applicant had cross-verified the GST Numbers of the firms in question and whereas while some of the firms had availed the GST credit, it is only upon the compliant being registered that they had reversed the entries.
