ORAL ORDER

(PER : HONOURABLE MS. JUSTICE SANGEETA K. VISHEN)

1. The captioned petition is filed by the applicant father seeking direction to the respondents to trace out the corpus. It is the case of the applicant that the corpus is missing since 21.12.2025. Necessary Janvajog, was filed by the husband of the corpus on 22.12.2025; however, till date, there is no development taken place despite passage of almost four months.

2. Mr Shrey H. Dave, learned advocate states that applicant- father is very much concerned about well-being of the daughter. Mr Shrey H. Dave, learned advocate has stated that even the communication was addressed to the District Superintendent of Police on 27.12.2025; however, it appears that either it has not been taken note of or the Superintendent of Police, was happy with the investigation at the level of the Police Inspector.

3. Ms Divyangna Jhala, learned Additional Public Prosecutor states that all the attempts are put by the officer concerned so as to trace out the corpus; however, till date, the corpus could not be traced out. Reports have been filed indicating the steps taken by the investigating officer. It is submitted that not only that but necessary communications have been addressed to the Unique Identification Authority of India (Regional Office) as well as the Forensic Science Laboratory, Gandhinagar for the purpose of the information related to the use of Aadhar Card as well as for undertaking necessary tests. It is submitted that steps are being taken unfortunately, the corpus could not be traced out.

4. It is not in dispute that the corpus is missing since 21.12.2025. Petition is filed on 02.02.2026. This Court, on 23.02.2026 has passed the following order:

“The respondent No.2-Nitinbhai Kalpeshbhai Bhaktibhai Chavda is present in the Court. He seeks time to engage the counsel. He is permitted to do so.

We have brought to the notice by the learned APP that the manner in which the complainant has been investigated, is far from satisfactory. The Learned APP assures us that, by the next date of hearing, she would have secured some positive information about the corpus.

Based on this assurance, we adjourn the matter to

03.03.2026.”

5. This Court has recorded that the investigation has far from satisfactory. Assurance was extended by the learned Additional Public Prosecutor that some positive information may be procured about the corpus. The matter thereafter was kept on 03.03.2026 when this Court, has passed the following order:

“Even today, we have noticed that the manner in which the complaint has been investigated right from the date on which the missing complaint has been filed is far from the satisfaction. Learned APP assures us that he would secure possible information as he has promised earlier within a period of two weeks.

Re-list the matter on 23/03/2026.”

6. Once again, on behest of the police officers assurance was extended by the learned Additional Public Prosecutor of securing possible information as promised earlier. The matter, thereafter, was kept on 23.03.2026; however, no positive development appears to have been taken place and therefore, on 23.03.2026, this Court has passed the following order:

“1. This Court, on 23/02/2026, passed the following order:
