ORAL ORDER
1. The present application has been filed by the applicant seeking temporary bail for a period of 20 days on the ground of medical treatment of his mother, whose operation is
scheduled on 07.04.2026.
2. Rule. Learned advocate Mr. Utkarsh Sharma for respondent No.1 – Director of Revenue Intelligence waives service of notice of rule. Learned Additional Public Prosecutor waives service of notice of rule on behalf of the respondent –
State.

and learned advocate Mr. Utkarsh Sharma for respondent No.1. Perused the case papers as well as the affidavit filed by
the Senior Intelligence Officer, DRI, Zonal Unit, Ahmedabad.
4. It transpires that the applicant is facing trial for offences punishable under Sections 8(c), 21, 23 and 28 of the NDPS Act in connection with FIR No. DRI/AZU/GI-02/ENQ-01/NDPS/2024, wherein contraband substance (Ketamine) weighing 58 kg was seized and the
applicant was apprehended.
5. It further appears from the jail record that the applicant has never been released on regular bail and his conduct in jail is reported to be satisfactory. It is also noted that the applicant was earlier granted temporary bail for a period of six days by the learned Sessions Judge in Criminal Misc. Application No. 3549 of 2025 for the period from 15.05.2025 to 21.05.2025 with police escort at his own cost; however, the
same could not be availed due to paucity of funds.
6. The present application is preferred on humanitarian grounds, more particularly for the operation of the applicant’s mother. Learned advocate for respondent No.1 has verified the said aspect with the concerned Investigating Officer, and the supporting documents placed on record are taken into
consideration.

7. Having regard to the nature of allegations, the seriousness of the offence, and the grounds urged, this Court is inclined to exercise discretion partly in favour of the
applicant.
8. The application, therefore, succeeds in part and is allowed. The applicant is ordered to be released on temporary bail for a period of seven days from the date of his actual release, on his furnishing a personal bond of Rs.10,000/- to the satisfaction of the concerned jail authority and subject to
the following conditions:
(a) The applicant shall be accompanied by one police officer during the period of temporary bail, the cost of which shall be borne by the State. (b) The applicant shall deposit a sum of Rs.5,00,000/- before the trial Court; the said amount shall be refunded upon surrender, subject to due verification. (c) The applicant shall mark his presence twice during the said period before the office of DRI. (d) The applicant shall cooperate with the investigation and shall not misuse the liberty granted. (e) The applicant shall surrender his passport, if any, before the trial Court. If the applicant does not possess a
passport, he shall file an affidavit to that effect.
