out a mistake crept in order dated 27.03.2026 passed in Misc. Civil Application No. 717 of 2026 in Special Civil Application No. 4126 of 2025, that in the above order through oversight in the cause title, “Misc. Civil Application No. 717 of 2026 in Special Civil Application No. 4126 of 2025” is inadvertently mentioned instead of “Misc. Civil Application No. 717 of 2026 in Civil Application No. 1 of 2025 in

Special Civil Application No. 4126 of 2025”.

Further, throughout the order, “restoration of Special Civil

Application No. 4126 of 2025” is inadvertently mentioned instead of

dated 27.03.2026 passed in Misc. Civil Application No. 717 of 2026 in

Special Civil Application No. 4126 of 2025.

One week time is extended to remove office objection, if any.

Accordingly, this note for speaking to minutes stands allowed.

ORAL ORDER

1. By way of this application the applicants seek condonation

of delay of 35 days in preferring Misc. Civil Application No.717 of 2026 for restoration of the Special Civil Application No.4126 of 2025 which came to be dismissed for non-

prosecution.

2. Heard Mr. Rushabh H. Munshaw, learned advocate for the

applicants.

3. Having gone through the averments made in the

application, this Court is of the view that the explanation

rendered by the applicant requires consideration and delay

of 35 days occurred in preferring Misc. Civil Application No.717 of 2026 is required to be condoned. Accordingly, the delay of 35 days which has occurred in preferring the Misc. Civil Application for restoration of the Special Civil

Application No.4126 of 2025 is condoned.
