mistake crept in order dated 12.03.2026 passed in Special Civil Application No. 3241 of 2026, that in the above order through oversight, in paragraph no. 3, “Regular Civil Suit No. 15 of 2024” is

mentioned instead of “Regular Civil Suit No. 14 of 2024”.

Office is directed to carry out above correction in order dated 12.03.2026 passed in Special Civil Application No. 3241 of 2026.

Accordingly, this note for speaking to minutes stands allowed.

ORAL ORDER

1. Heard Mr. Zubin Bharda, the learned advocate appearing for the petitioner.

2. By way of present petition, the petitioner herein has prayed that the RTS /Revision /178 of 2025 pending before the Collector, Dahod, District Dahod be quashed and set aside in light of the fact that the private respondents herein had initiated Civil Suits wherein the order is passed below Exh.-1 dated 17.09.2025 duly produced on record. It is submitted that the respondent herein challenged the order passed by the Deputy Collector (Annexure ‘N’) approved on 09.07.2025 wherein

it was rejected.

3. After the withdrawal of the suit proceedings that the petitioner has challenged the order passed by the Deputy Collector dated 09.07.2025 before the Collector herein. It is submitted that such appeal preferred before the learned Collector challenging the order passed by the Deputy Collector after withdrawal of the suit proceedings being Regular Civil Suit No.15 of 2024 are such that the same would be without jurisdiction. The order of the Deputy Collector having been challenged after the

withdrawal of the suit proceedings.

4. Issue Notice, returnable on 10.04.2026. In the interregnum period, in the interest of justice, the Revision Proceedings being RTS /Revision /178 of 2025 are directed not to be continued till the next returnable

date.

Direct service is permitted.
