JUDGMENT

1. The present Application is filed under Section 24 of the Code of Civil Procedure, 1908 (hereinafter, referred to as “CPC”) praying for the transfer of Family Suit No. 2280 of 2025 pending before the learned Family Court at Ahmedabad to the competent Court at

Jamnagar.

2. Heard learned advocate Ms. Dhruma Vyas for the applicant.

3. The brief facts of the case are as under:

3.1 The marriage between the parties was solemnized on 21.05.2017 at Ahmedabad. No child was born out of the said wedlock. Disputes cropped up between the parties. Complaints before the Mahila Police Station, Jamnagar were filed by the applicant – wife on 25.03.2021 and 19.06.2023 against the respondent – husband for physical harassment. The respondent – husband has filed a suit under Section 13A of the Hindu Marriage Act, 1955 for a decree of dissolution of the marriage before the learned Family Court

at Ahmedabad being Family Suit No. 2280 of 2025.

4. Learned advocate for the applicant submits that the marriage between the parties was solemnized on 21.05.2017 at Ahmedabad as per the Hindu Marriage Rites and Ceremonies. It is submitted that the parties are living separately as on today. Applicant is staying at Jamnagar with her parents. It is submitted that complaints before the Mahila Police Station, Jamnagar were filed by the applicant – wife on 25.03.2021 and 19.06.2023 against the respondent – husband for physical harassment. It is further submitted that the respondent – husband has filed a suit under

Section 13A of the Hindu Marriage Act, 1955 for a decree of dissolution of the marriage before the learned Family Court at Ahmedabad being Family Suit No. 2280 of 2025 just to harrass the applicant. It is submitted that the distance between Ahmedabad and Jamnagar is approximately 370 kms. one way and travelling in bus takes about 8 to 9 hours. Learned advocate for the applicant urged to allow the present application by transferring the Family Suit No. 2280 of 2025 from learned Family Court, Ahmedabad to competent Court at Jamnagar, considering the financial constraints and inconvenience to the wife and in the larger interest of justice. Except above, no other submissions were made by learned

advocate for applicant.

5. I have considered the submissions canvassed by learned advocate for the applicant and the averments made in the application. Considering the facts of the present case, it would be very difficult for the applicant – wife, being a lady to attend the Court proceedings before the learned Family Court at Ahmedabad from Jamnagar. The distance between the aforesaid two places is approximately 370 kms. one way. She has to look after her parents who are senior citizens. The application, therefore, needs
