ORAL ORDER

1. By way of preferring the Note for Speaking to Minutes, learned advocate Mr. Bhash H. Mankad appearing for the applicants has pointed out that through inadvertence, the words “delivered on 14.08.2025” appearing in the second last line of the paragraph No.2 of the order dated 09.04.2026 passed by this Court, have been wrongly typed, instead of “posted on 11.08.2025”, which are required to be corrected. Therefore, he has requested this Court to rectify the said error, and modify

the order accordingly.

2. Perused the Note. The request seems to be germane and,

therefore, the same is hereby acceded to.

3. Considering the aforesaid, the words “delivered on 14.08.2025” appearing in the second last line of the paragraph No.2, of the order dated 09.04.2026 be rectified and read as

“posted on 11.08.2025”.

4. The registry shall carry out the necessary corrections accordingly and issue a fresh writ of the order.

5. With the above, the Note for Speaking to Minutes stands disposed of.

1. Heard learned advocate Mr. Bhash Mankad appearing for the applicants.

2. Perused the entire material placed on the record along with the impugned complaint. It prima facie appears that the cheques in question were presented and allegedly returned unpaid vide return memo dated 09.07.2025, with the remarks “Account Closed”. It appears that the complainant has pleaded in the complaint that statutory notice was issued on 07.08.2025 and the same was posted on 08.08.2025. However, considering the documentary evidence at Annexure -B, in fact it appears that the statutory notice was actually delivered on 14.08.2025, (i.e. beyond the period of limitation of 30

days).

3. Issue NOTICE to the respondents, making it returnable on

23.06.2026.
