IA ORDER
1. Mr.Sukumar Tirthani, learned Advocate for the applicant i.e Haifa Maritime Co. Ltd., has filed an application under Order I Rule 10(2) read with Section 151 of the Code of Civil Procedure, 1908, seeking intervention in the present Admiralty Suit and be impleaded as a defendant. Learned advocate further stated that the applicant has also instituted a separate Admiralty Suit bearing R/AS No.68 of 2025 before this Hon'ble Court in respect of the Defendant Vessel MV Elvita R, having supplied spares, parts, provisions and other services and the sums due to the Applicant being outstanding. Learned advocate further submitted that the applicant has filed the present application to intervene in the captioned suit
for the purpose of securing interest in the defendant vessel.

2025, this Court passed an order of arrest of the Defendant Vessel at the instance of the applicant in R/AS No.68 of 2025. Pursuant to the said order, the Defendant Vessel was arrested and is presently lying at Bedi Port, Jamnagar within Indian territorial water and within admiralty jurisdiction of this Court. It is further stated that the applicant is not, by this application, dealing with various claims, contentions and allegations made by the plaintiff in the plaint, and therefore nothing stated therein ought to be deemed to be admitted by the applicant. Learned advocate further submitted that the applicant craves leave of this Court to file such further affidavits and pleadings, to oppose the reliefs claimed in the
plaint, including interim and ad-interim reliefs.
3. The Learned advocate further submitted that the applicant has supplied various services, parts and equipment to the Vessel, for which amounts are outstanding. The Learned advocate further submitted that for the reasons stated in the OJ CIVIL APPLICATION NO. 2 OF 2026 (FOR JOINING PARTY), the applicant is a necessary and proper party to the present proceedings, having a direct proprietary and maritime interest therein because the final adjudication of the plaintiff's claim may have a direct impact on the applicant's claim. Learned advocate further submitted that the present case is a fit and proper case for this Court to exercise its power under Order I Rule 10(2) read with Section 151 of the Code of Civil Procedure, 1908, and that the applicant be permitted to intervene in the present Suit and be impleaded
as a Defendant.
4. The Learned advocate further submitted that by an order dated 6th January 2026 passed by this Court in the
