JUDGMENT :
1. Heard Mr. Prince S. Datta, learned advocate for Mr. S.P. Majmudar, learned advocate appearing for the petitioners, Mr. Jayneel Parikh, learned AGP appearing for the respondent – State authorities, Mr. Nikhil S. Vyas, learned advocate appearing for the private respondent Nos.11.1, 11.2 and Mr. A.S. Timbalia, learned advocate appearing for the private respondent Nos.8 to 10.

By way of present petition, the petitioners herein are constrained to invoke Article 227 of the Constitution of India, challenging the impugned order dated 10.01.2017 passed by the Deputy Collector in RRT/Delay Condone/Appeal Case No.23 of 2016, the impugned order dated 08.06.2017 passed by the District Collector in Land/4/RRT Revision No.119/2016-17, the impugned order dated 24.02.2018 passed by the respondent – SSRD in Revision Application No.MVV/HAKAP/JANADH/87 of 2017 as well as the impugned order dated 17.07.2018 passed by the District Collector in suo-motu proceedings being Land/4/RRT/Revision/8/2018.
3. The petitioners purchased the lands bearing, Survey No.61/p1/p1, admeasuring 3-23-75 Hec.-Are-Sq. Mtrs., Survey No.61/p1/p3 admeasuring 3-75-35 Hec.-Are-Sq. Mtrs., Survey No.176 admeasuring 0-93-08 Hec.-Are-Sq. Mtrs., in all admeasuring 7-92-18 Hec.-Are.-Sq. Mtrs., of Village : Pikhor, Taluka : Maliya Hatina, District : Junagadh, by way of registered sale deeds dated 06.12.2012 for which, Entry Nos.2740, 2741 and 2742 came to be mutated in the revenue record on 07.12.2012 and certified on 30.01.2013. The said entries came to be cancelled by the impugned order passed by the District Collector, in suo-motu proceedings being Land/4/RRT/Revision/8/2018, coupled with the earlier entries mutated in the names of the predecessor in title and for the other parcels of land purchased by the respondent Nos.11.1 and 11.2. In view thereof, the petitioners herein have filed the present petition having prayed for the following reliefs:
“(A) YOUR LORDSHIPS may be pleased to issue a writ of mandamus or a writ in the nature of mandamus or any other appropriate writ, order or directions quashing and setting aside the impugned order dated 10.01.2017 passed by the Deputy Collector in RRT/Delay Condone/Appeal Case No.23 of 2016 (at ANNEXURE-F hereto), impugned order dated 08.06.2017 passed by the District Collector in Land/4/RRT Revision No. 119/2016-17 (at ANNEXURE-H hereto), impugned order 24.02.2018 passed by the respondent-SSRD in Revision Application No. MVV/HAKAP/JANADH/ 87 of 2017 (at ANNEXURE-I hereto), as well as the impugned order dated 17.07.2018 passed by the District Collector in suo motu proceedings being Land/4/R.R.T. Revision/8/2018 (at ANNEXURE-J hereto);
(B) During the Pendency and Final Disposal of the no present petition YOUR LORDSHIPS may be pleased to stay further operation, implementation and execution of the impugned order dated impugned 10.01.2017 passed by the Deputy Collector in RRT/Delay Condone/ Appeal Case No. 23 of 2016 (at ANNEXURE-F hereto), impugned order dated 08.06.2017 passed by the District Collector in Land/ 4/RRT Revision No. 119/2016-17 (at ANNEXURE-H hereto), impugned order 24.02.2018 passed by the respondent-SSRD in Revision Application No. MVV/HAKAP/JANADH/ 87 of 2017 (at ANNEXURE-I hereto), as well as the impugned order dated 17.07.2018 passed by the District Collector in suo motu proceedings being Land/4/R.R.T. Revision/8/2018 (at ANNEXURE-J hereto) and further be pleased to direct the respondents to maintain status -quo with respect to the lands question i.e. lands situated at Revenue Survey No.61/p1/p1 (admeasuring 3-23-75 Hec. -Are- Sg.mtrs.), No. 61/p1/p3 (admeasuring 3-75-35 Hec. -Are-Sq.mtrs.) and No.176 (admeasuring 0-93-08 Hec. -Are- Sq.mtrs.), in all admeasuring 7-92-18 Hec. -Are-Sq. mtrs. of Village Pikhor, Tal. Maliya Hatina, Dist. Junagadh;
(C) Pass any such other and/or further orders that may be thought just and proper, in the facts and circumstances of the present case.”
