The court may grant conditional permission for a party to travel abroad for business purposes, provided the party provides a security deposit and a formal undertaking to return and abide by specific restrictions to ensure the integrity of the legal proceedings.

IA ORDER

1. Mr. Jaimin R. Dave, learned advocate for the applicant, submitted that the applicant is desirous of traveling abroad at multiple places, details whereof are given in paragraph-5 of the present application, for the period from 22.04.2026 to 30.04.2026, from 11.05.2026 to 29.05.2026, from 02.06.2026 to 16.06.2026 and from 19.06.2026 to 02.07.2026 for business purpose. However, the dates shown in the Itinerary 1 at paragraph no. 5 have already lapsed. Therefore, it is submitted that applicant will limit his application from Itinerary 2 at paragraph no. 5. It is submitted that applicant shall abide by the terms and conditions as may be imposed and shall return back to India.

2. Mr. Dhruvkumar S. Chauhan, learned advocate for the respondent No.3 Bank has urged this Court to pass appropriate order. So also Mr. Ankit Shah, learned Central Government Standing Counsel and Mr. R. C. Kodekar appearing for respondent no. 4 have urged before this Hon’ble Court to permit applicant to travel abroad subject to terms and conditions as provided in orders dated 08.01.2025, 08.04.225 and 24.12.2025.

3. Heard the learned advocates appearing for the respective parties.

The applicant has prayed for permission to travel abroad, as stated in para-5 of the present application for the period from 11.05.2026 to 29.05.2026, from 02.06.2026 to 16.06.2026 and from 19.06.2026 to 02.07.2026 for business purpose. The applicant also undertakes to abide by the terms and conditions as may be imposed by this Court. Accepting the request partly, this Court is inclined to allow the application permitting him to travel abroad, as stated in para-5 of the present Civil Application, for the period from 11.05.2026 to 29.05.2026, from 02.06.2026 to 16.06.2026 and from 19.06.2026 to 02.07.2026 for business purpose on fulfilling the conditions as indicated herein-below:-

a. The applicant has already made a deposit of Rs.20,00,000/(Rupees Twenty Lacs only) by way of Demand Draft in the name of Registrar, High Court of Gujarat, and the same is lying deposited in the account. The said amount shall be treated as security in the present application.

b. That applicant shall file an undertaking indicating:

i. his flight details and the date of arrival in India;

ii. itinerary of his visits and places of residence of foreign country before the departure with the Registry of the Court;

iii. that on or before the date 02.07.2026, he shall return to this country;

iv. he shall report to the respondent no.1, as and when required;

c. that the applicant shall not open or close any bank account overseas and shall not enter into any kind of property transactions abroad;

d. that the applicant shall not seek any adjournment in any proceedings before any authority and/or court on the ground that he is out of country.

e. If the undertaking and the aforesaid terms are not complied with, the applicant shall face such consequences as may be deemed fit and appropriate.

5. The aforesaid undertaking shall be filed with a copy to Mr. Ankit Shah, learned Central Government Standing Counsel, Mr. Dhruvkumar S. Chauhan, learned advocate for the respondent No.3 Bank and Mr. R. C. Kodekar, learned counsel for respondent No. 4.

6. In view of the above, the Immigration Authorities at all ports of departure including airports are directed to permit the applicant to clear immigration and board his flights. The Bureau of Immigration shall update its system to permit the free passage of the applicant in conformity with the present order upon receipt of copy of this order.
