1. Heard learned AGP Mr. Jay Barot appearing for the Applicant.
2. By way of this application, the Applicant has prayed for permission to serve notice to Respondent No.2 by way of publication in vernacular language in the local newspaper having wide circulation in the area where the said Respondent No.2 have lastly resided, at the cost of the Applicant.
3. The learned advocate for the Applicant has submitted that pursuant to the issuance of notice by the Hon’ble Court, notice to the Respondent No.2 was issued to the address mentioned in the cause title of the present Petition but the same is unserved as the Respondent No.2 is not found at the given address and, therefore, the Applicant has also approached at the address which is mentioned in the cause title of the Regular Civil Suit, but at this address also the Respondent No.2 could not serve as he has not found at that address also. He has further submitted despite the best efforts and endeavor by the present Applicant, he has not getting a detail about the unserved Respondent. Therefore, he has requested to allow the present Application for substitue service of notice.
4. Considering the facts and circumstances emerging from the record, prayer for substituted service in terms of prayer para 11(B) of the present Civil Application is permitted. The Applicant is permitted to serve the aforesaid unserved Respondent No.2 by way of publishing the service of notice in captioned Civil Application No. 4772 of 2024 in F/Civil Revision Application No. 25955 of 2024, in vernacular language in local newspaper having wide circulation in the vicinity where the aforesaid unserved Respondent No.2 was known to have actually and voluntarily resided, carried on business or personally worked for gain.
5. The cost of substituted service shall be borne by the Applicant.
6. The aforesaid process of substituted service shall be carried out within 6 weeks from the date of this order. The office shall take all necessary steps in the above regard.
7. Accordingly, the present Civil Application stands disposed of.
