For the Appellants/Petitioners: Jaydeep H Sindhi
For the Respondents: Aditya Jadeja
The court held that the Registry must act with due diligence and precision in complying with judicial orders, and filing evasive or irrelevant notes to circumvent specific directions is impermissible as it delays proceedings.
Headnote:(A) Judicial Administration - Registry Compliance - Failure of the Registry to comply with specific judicial directions by filing irrelevant or evasive notes reflects a lack of due diligence and causes unnecessary delay in proceedings. (Para 3)
Issues: Whether the Registry complied with the court's direction to determine if the matter was a fresh matter or required to be placed before a specific Bench.

ORAL ORDER
1. The matter was listed before this Court on 21.04.2026, on which date the following order was passed:
"The record shows that the matter is not a fresh matter hence, Registry is directed to place the present application before the appropriate Bench."
2. Despite the aforesaid specific order, and without verifying as to whether the matter is in fact a fresh matter or otherwise, the Registry has placed a note stating merely that the matter is not kept as "part-heard." The issue for consideration was not whether the matter was marked as "part-heard," but whether it was a fresh matter or one required to be placed before the appropriate Bench in view of the earlier order passed in the proceedings.
3. The conduct of the Registry in filing such an irrelevant and incomplete note, without addressing the specific direction issued by this Court, reflects a clear lack of due compliance with the judicial order and has unnecessarily delayed the proceedings. The Registry is expected to act with due diligence and precision while complying with orders of the Court and not to circumvent the issue by filing evasive notes.
4. The Registry is, therefore, once again strictly directed to examine the record and file a proper note specifically stating whether the present matter is a fresh matter or not, particularly in view of the order passed by the Coordinate Bench dated 16.02.2026, which reads as under:
“1. Heard learned advocate Mr. Jaydeep Sindhi appearing for the applicant and learned APP Ms. Krina Calla appearing for the respondent – State.
2. Learned APP Ms. Krina Calla is directed to call for the fresh reports from the Investigating Officer by the next date of hearing.
3. The Investigating Officer is also directed to remain present before this Court with all the necessary papers on the next date of hearing.
4. Stand over to 09.03.2026”
5. Learned Advocate Mr. Jaydeep H. Sindhi for the applicant submits that the matter was heard at length by the Coordinate Bench. Therefore, he has no objection to the matter being listed before the Coordinate Bench.
6. List the matter on 29.04.2026.
