Employees completing mandated service periods before the adoption of new resolutions retain rights under previous rules for pay scale benefits. Retroactive promotion claims fail when candidates lack mandatory qualifications at the time of departmental committee review, compounded by significant delay in seeking judicial intervention.

Facts of the case:
The petitioner sought the grant of a first higher pay scale from the date of passing a departmental examination rather than from the date of completion of twelve years of service. Additionally, the petitioner requested a deemed date of promotion for a group-specific post, claiming parity with the date a junior was promoted to that position.

Findings of Court:
The court determined that the petitioner, having completed nine years of service by the date of a particular government resolution, was governed by the previous policy which permitted higher grade scale benefits from the date of passing the required departmental examination. Regarding the claim for a deemed date of promotion, the court rejected the plea on the grounds of inordinate delay and the fact that the petitioner had not satisfied the examination requirement at the time the promotional committee originally met.

Issues: The main issues were which government resolution governs the entitlement to an initial higher pay scale for an employee with nine years of service, and whether a claim for a deemed date of promotion is permissible when the employee had not cleared the departmental examination at the time the promotion was considered by the committee.

Ratio Decidendi: Transitional clauses within government resolutions protect the rights of employees who reached specific service milestones while previous policies were in effect. Regarding promotions, established administrative circulars requiring valid examination results at the time of committee review take precedence over subsequent claims, particularly when such claims are pursued after a substantial lapse of time.

Result: Petition partly allowed.

JUDGMENT

1. Heard Mr. Rishabh Acharya, learned Advocate appearing on behalf of Ms. Harshal N. Pandya, learned Advocate for the petitioner and Mr. Siddharth Rami, learned Assistant Government Pleader for the respondents.

2. RULE returnable forthwith. Mr. Siddharth Rami, learned Assistant Government Pleader, waives service of notice on behalf of the respondents. With the consent of the parties, the matter was heard finally.

3. The present writ petition is filed under Article 226 of the Constitution of India, seeking the following reliefs:

“(A) hold and declare that petitioner is eligible entitled to get first higher grade scale from 4.4.2008 instead of 17.8.2009 and also to get deemed date of promotion in Group-III post fro, 6.6.2009 i.e. the date on which junior was promoted, and

(B) further be pleased to direct the respondent authorities to grant first higher grade scale from 4.4.2008 instead of 17.8.2009 with all consequential benefits with interest at the rate which the Honourable Court may consider as just and proper in the facts of the case, and

(C) direct the respondent authorities to grant deemed date of promotion in Group-III from 6.6.2009 i.e. the date on which his immediate junior was promoted and accordingly, seniority be corrected and also to consider the case of petitioner for promotion in Group-II posts from the date on which junior was promoted i.e. 16.3.2016, and

(D) award the cost of this petition, and

(E) pending admission and final disposal of this petition, the Honourable Court may be pleased to consider the case of petitioner for promotion to Group-II post, and/or

F) grant any other relief or pass any other order which the Honourable Court may consider as just and proper in the facts and circumstances of the case.”

4. SHORT FACTS:

4.1. The short controversy germane to this matter in regards to the non-granting benefit of first higher pay scale to the petitioner from the date of passing the departmental examination, but from other date, by applying the Government Resolution dated 02.07.2007.

4.2. The other issue is of the deemed date of promotion of the petitioner in Group-III post as, according to the petitioner, he was entitled to receive promotion w.e.f. 06.06.2009, whereas, it was granted on 08.03.2011.

4.3. The petitioner was appointed as a Junior Clerk (Group-IV) in the Sub-Treasury Office, Umrala, District Bhavnagar, on 16.08.1997. After his transfer, he was posted at the Gandhinagar office in 2001.

4.4. The petitioner could not clear the departmental examination in three attempts, but in the fourth attempt, on 04.04.2008, he cleared the departmental examination, whereby, he was eligible to receive promotion in Group-III post.

4.5. Before the passing of the examination, the Departmental Promotion Committee (hereinafter referred to as “D.P.C.”) met on 02.02.2008, since the petitioner had not cleared the examination on that day, his case was not considered for promotion.

4.6. Upon passing the examination on 04.04.2008 and in the next DPC, the petitioner’s case was considered for promotion and accordingly, he was granted promotion vide respondent’s order dated 09.02.2011 / amended order dated 08.03.2011.

4.7. So far as the granting of first higher pay scale is concerned, the respondent was of
