IA ORDER

1. This application is filed seeking modification of

Condition No. 6(iii) imposed vide order dated 20.11.2025

passed in the captioned revision application, whereby, the

applicant was directed not to leave India without prior

permission of the Court.

2. Heard, learned advocate for the applicant and the

learned advocate for the respondents.

2.1. The learned advocate for the applicant submits that

the applicant along with his wife wanted to travel for Hajj

for religious purpose. He further submits that as per the

travel plan of the applicant, he booked a ticket of

19.05.2026. Accordingly, it is urged that the aforesaid

Conditions may be modified and he be permitted to travel

abroad for Hajj between 19.05.2026 to 31.07.2026.

3. Per contra, the learned Additional Public Prosecutor

for the State has opposed the application, however, she

submits that if this Court is inclined to grant the

permission, in that case, strict conditions may be

imposed.

4. Having regard to the submissions made and

considering the averments made in the application this

Court is inclined to exercise discretion in favour of the

Applicant.

5. Resultantly, this application is allowed in part. The

Condition No. 6(iii), imposed vide order dated 20.11.2025

passed in the captioned revision application is suspended

upto 31.07.2026. The applicant is permitted to travel

abroad for Hajj upto 31.07.2026 and submit the Itinerary/

Schedule/Programme with the trial court concerned

before 3 days of his departure, on the conditions that the

applicant:

a) shall forthwith submit photostat copies of

Passport and Air tickets to concerned Court;

b) shall give his correct and complete address with

telephone number and mobile number of the places

he intends to visit during the aforesaid period to

concerned Court;

c) shall not misuse his liberty;

d) shall not delay the proceedings citing his

absence;

e) shall deposit sum of Rs.50,000/- before the trial

court and after return from abroad would entitled

to withdraw the said amount with interest if any

accrued.

6. With aforesaid, this application is disposed of.

7. Direct service is permitted.
