In death reference cases, the court must ensure a comprehensive evaluation of mitigating and aggravating circumstances through probation reports, jail conduct reports, and psychological evaluations, while providing robust legal representation to the convict.

Headnote:The matter pertains to a death reference and criminal appeal arising from a judgment dated 05.05.2022 by the District and Sessions Court, Surat, where the convict was found guilty under Sections 302, 307, 354(D)(1)(i), 342, 504, and 506(2) of the Indian Penal Code and sentenced to capital punishment. The court has stayed the execution of the death sentence pending the final disposal of the appeals. The court addressed the necessity of evaluating mitigating and aggravating circumstances before confirming a death sentence. Relying on the guidelines established in Aman Singh and another v. State of Bihar, the court reasoned that comprehensive reports regarding the convict's probation, jail conduct, and psychological state are essential for a fair determination of the sentence. The execution of the death sentence of the appellant shall remain stayed pending the hearing and final disposal of the present appeals.
