ORDER

1. This application is filed under Section 483 of the Bharatiya

Nagarik Suraksha Sanhita for regular bail in connection with

F.I.R. No.11210045242692 of 2024 registered with

Pandesara Police Station, District Surat City for the offences

punishable under Sections 8(c), 20(b)(II))(c) and 29 of the

Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Learned advocate for the applicant submitted that the

applicant is a lady, who has been arrested in connection with the

present offence on 15.07.2024. As per the case of prosecution,

the contraband substance ganja worth 20.152 kgs seized from

the premises belonged to the present applicant. However, there

is nothing on record to indicate that the premises in question

belonged to the present applicant. The trial has not been

satisfactorily progressed after dismissal of the earlier application

filed by the present applicant. He, therefore, submitted that

considering the nature of offence and role attributed to the

applicant, the applicant may be enlarged on regular bail by

imposing suitable conditions.

3. The learned APP appearing for the respondent State

vehemently submits that the offences alleged against the present

applicant is serious in nature. He further submits that the

allegations against the applicant, are serious in nature and

looking to the facts as well as the allegations made against the

applicant, no discretion should be exercised.

4. Heard learned advocates for the respective parties and

perused the documents produced on record. The applicant had

earlier preferred Criminal Misc. Application No.20703 of 2024

which was dismissed by this Court vide order dated 17.02.2025.

While dismissing the said application, this Court has made the

following observations:-

“5. From the record it appears that place on which the police

authority has raided on the basis of secret information and the

applicant was found present in the said house possessing

contraband substance worth 20.215 kgs. From the record it also

appears that the quantity involved in the present offence prima

facie appears to be commercial quantity though it is the case of

the applicant that as per settled position of law weighed of only

of flowering tops of cannabis plants is required to be taken into

consideration while deriving quantity which is the subject matter

of trial.”

5. The record also indicates that the applicant is having

another antecedents similar in nature. Considering these facts,

Court is not inclined to exercise its judicial discretion in favour

of the applicant. The application is dismissed.
