ORAL ORDER
1. The present miscellaneous application has been filed by the applicants-accused seeking the following reliefs :
“(A) Your Lordships may be pleased to admit and allow the present application;
(B) Your Lordships may be pleased to restore the prayer/s mentioned in the application earlier and permit to rectify the correct number of the proceedings by substituting with “Sessions Case No.40 of 2025” in place of “Sessions Case No.4 of 2025”;
(C) Your Lordships may be pleased to direct the registry of this Hon’ble Court to issue fresh order/writ with the correction stated above;
(D) Your Lordships may be pleased to pass such other and further relief(s) as may be deemed fit and proper in the interest of justice.”
2. Learned advocate Ms.Bhavna D.Aacharya appearing for the applicants – original accused has submitted that this Court, vide order dated 08.04.2026 passed in the Criminal Misc. Application No.8113 of 2026, allowed the application filed by the applicants-accused and was pleased to quash and set-aside the First Information Report being C.R. No.I-11209017240667 of 2024 registered with the Himmatnagar Rural Police Station, District Sabarkantha, as well as, the proceedings of the Sessions Case No.04 of 2025 pending before the Sessions Court, Sabarkantha at Himmatnagar.

By way of filing the present miscellaneous application, learned advocate Ms.Aacharya has submitted that through inadvertence on her part, she had wrongly mentioned the Sessions Case No.04 of 2025 instead of Sessions Case No.40 of 2025 pending before the Sessions Court, Sabarkantha at Himmatnagar. She apologizes for the said mistake and requested this Court to rectify and modify the order to that effect and issue a fresh writ of the order.
4. Having heard learned advocate Ms.Aacharya for the applicants-accused and having gone through the order dated 08.04.2026 passed by this Court in the Criminal Misc. Application No.8113 of 2026, it prima facie appears that through inadvertence on the part of the learned advocate, the Sessions Case No.04 of 2025 has been wrongly shown instead of the Sessions Case No.40 of 2025 pending before the Sessions Court, Sabarkantha at Himmatnagar.
5. Registry is, therefore, directed to carry out the necessary corrections in the order accordingly and issue a fresh writ of the order.
6. With the above, the present criminal miscellaneous application stands disposed of. Direct service is permitted.
7. Learned advocate Ms.Aacharya is hereby instructed to be more careful in future while submitting at the Bar.
