IN THE HIGH COURT OF GUJARAT AT AHMEDABAD
M. K. Thakker, J
JAYDEEP SUDHAKAR BIREWARV/sSTATE OF GUJARAT
R/CRIMINAL MISC.APPLICATION (FOR DOMESTIC VIOLENCE) NO. 13638 of 2026

Advocates:
For the Appellants/Petitioners: Kishan R Chakwawala, Shyam R Chakwawala
For the Respondents: Monali Bhatt, M.A. Shah

Criminal proceedings arising from matrimonial disputes can be quashed by the High Court if the parties have reached an amicable settlement, as continuing such proceedings would constitute an abuse of the process of law and unnecessary harassment.

Headnote:The applicant sought the quashment of a complaint filed under Section 12 of the Protection of Women from Domestic Violence Act, 2005, pending before the 3rd Additional Civil Judge, JMFC at Ahmedabad. The matter arose from a matrimonial dispute which the parties subsequently resolved through an amicable settlement, as confirmed by an affidavit filed by the complainant stating that the dispute was of a personal nature and resulted from a misunderstanding. The court examined whether the continuation of criminal proceedings was justified given the mutual compromise. Relying on established precedents, the court reasoned that continuing the proceedings in light of the settlement would be an unnecessary harassment to the accused and a futile exercise, thereby amounting to an abuse of the process of law. The impugned complaint being CRMA No.J/2521/2025 before the learned 3rd Additional Civil Judge, JMFC At Ahmedabad Civil, Court is quashed.
