3. The issue raised in the present petition is with regard to securing benefit, as the petitioner would have been entitled to from the date of appointment, without any reference to the policy of the State Government of appointment, on contractual basis on fixed pay. The case of the petitioner being that the petitioner is legal heir of employee who had died in harness and whereas, it is the case of the petitioner that the demise of the person in employment, was prior to 15.06.2004, by which policy, the State had introduced fresh appointments in the State, on contractual basis on fixed pay for a period of 5 years. The said representation would be made within a period of 15 days from the date of receipt of this order.
(ii) Upon the representation being received, the concerned authorities are directed to verify the date of demise, and if the petitioner is entitled otherwise, then the direction of this Court, as modified by the Hon’ble Division Bench as regards treating the present petitioner as being appointed on regular pay-scale from the date of their actual appointment, shall enure in favour of the petitioner also. Furthermore, as directed by the Hon’ble Division Bench, the petitioner would only be entitled to arrears for a period of 3 years preceding the date of filing of the writ petition.
(iii) If case the petitioner is deemed to be entitled, the respondents are directed to issue modified appointment order to the petitioner inasmuch as the date of the appointment of the petitioner would be treated as the date on which the petitioner has
