Respondent-Corporation has not accepted petitioner’s application seeking employment on compassionate grounds, hence this writ petition.
2. Petitioner’s father-late Sh. Jai Ram was serving as Mechanic in respondent-corporation. He died in harness on 03.05.2015. Petitioner applied for employment against the post of Clerk (Class-III) under the Kith & Kin Policy of the respondent in July 2015. Since the appointments under the Kith & Kin Policy were being made in respondent-corporation on the basis of seniority as per date of death keeping in view the vacancy available under the Policy against 5% of all direct vacancies in the calender year, petitioner’s case was kept under consideration. Since no post of Class-III category was available under the compassionate employment quota, the petitioner in the year 2022 submitted his written consent for compassionate appointment against Class-IV post on daily wage basis. His case was accordingly placed by the respondents before the Screening Committee on 30.03.2022. The Screening Committee did not recommend petitioner’s case for compassionate appointment due to his family income of Rs.2,44,000/- per annum being higher than the
