Present civil writ petition is filed under Article 226 /227 of Constitution of India with the prayer to quash and set-aside the award dated 03.9.2014 passed by learned Central Govt. Industrial Tribunal- cum-Labour Court-I Chandigarh in Case No. ID83 of 2013 titled Devki Nand Kalta vs. Chairman Managing Committee ARTRAC Canteen Shimla (H.P.) & Another.

BRIEF FACTS OF THE CASE

2. It is pleaded that on 07.06.2002 non-petitioner Devki Nand Kalta was appointed as Salesman in Unit Run Canteen (URC) ARTRAC Shimla on temporary basis. It is further pleaded that on 15.11.2011 non-petitioner was transferred to URC Mandi. It is further pleaded that on 30.11.2011 non-petitioner obtained stay order from CAT against the transfer order dated 15.11.2011 and did not join his posting station. It is further pleaded that thereafter in the month of April 2012 petitioner filed CMPMO No. 112/2012 assailing the order dated 30.11.2011 passed by Central Administrative Tribunal in OA No.1266/HP/11.
