Sandeep Sharma, J. (Oral) Being aggrieved and dissatisfied with order dated 14.12.2023, passed by the Financial Commissioner (Appeals) Himachal Pradesh at Shimla, whereby revision petition No. 40 of 2022, having been filed by the petitioner, laying therein challenge to order dated 21.1.2022 passed by the Divisional Commissioner, Mandi, Division, Mandi, in case No. 164/2019, upholding the orders dated 28.6.2019 and 5.11.2018, passed by the Collector, Sub-Division, Sundernagar and Assistant Collector 1st Grade, Nihri, came to be dismissed, petitioner has approached this court in the instant proceedings, praying therein to set aside order of eviction passed by the revenue authorities.

Precisely, the grouse of the petitioner, as has been highlighted in the petition and further canvassed by Mr. Narender Guleria, learned counsel for the petitioner is that authorities including the Financial Commissioner (Appeals), while passing order impugned in the instant proceedings, failed to take note of the fact that specific plea with regard to adverse possession qua the land alleged to have been encroached by the petitioner was taken, but, yet, Assistant Collector 1st Grade, failed to conver
