complainant (hereinafter referred to as the complainant) under Section i378 of Criminal Procedure Code (for short “Cr.P.C.”) against judgment dated 17.07.2013, passed by learned Judicial Magistrate 1^st Class, Court No.3, Shimla, District Shimla, H.P., in Criminal Complaint No.1941-3 of 2010/09, whereby the accused (respondent herein) was acquitted of the offence punishable under Section 138 of the Negotiable Instruments Act (for short, “the NI Act”).
