Notice of this petition was issued on 22.12.2021.

The petition was admitted on 14.07.2022. Till date, the respondents

have not filed reply.

2. With the consent of learned counsel for the parties, the

matter is heard at this stage.

3. Petitioner seeks regularization of her services from the year 2005 i.e. on completion of 8 years of service. The case set up by the petitioner is that she started working with the respondents as part-time Clerk w.e.f. 01.07.1997 under self-financing coaching programme in the pre-examination coaching centre. She was, 1 Whether reporters of the local papers may be allowed to see the judgment? yes

thereafter, appointed as Clerk-cum- Library Assistant on contractual basis on 17.01.1998. Under office order dated 25.07.1998, the petitioner was re-engaged as Clerk-cum-Library Assistant on contractual basis. It is the case of the petitioner that she had completed 8 years of service in the year 2005 and therefore, she was required to be regularized from the year 2005, whereas the respondents regularized her services under office order dated

07.08.2010 (Annexure P-5) with immediate effect.

In support of her prayer for regularization of service upon completion of eight years in 2005, reliance has been placed on the proceedings of the VI Meeting of the Advisory Committee held on 23.08.2005 (Annexure P-4), particularly Item No. 3 therein, wherein one Sh. Rakesh Kumar, serving as a Peon against a vacant post, was recommended for regularization on completion of eight years of service.

In view of the documents placed on record, this writ petition is disposed of with direction to respondent No.1 to consider the case of the petitioner for regularization of her services in accordance with law, keeping in view the documents on record, more particularly the Proceedings of the VI regular meeting of the Advisory Committee held on 23.08.2005 (Annexure P-4) and the office order dated 07.08.2010 (Annexure P-5) whereunder services of the petitioner were regularized with immediate effect. This exercise shall be carried out within six weeks. The order so passed be also communicated to the petitioner. Pending miscellaneous applications, if any, shall also stand disposed of.
