Precisely the grouse of the petitioner as has been

highlighted in the petition and further canvassed by Mr. Adarsh

Sgharma, learned counsel for the petitioner is that though petitioner

while applying for post of Junior Office Assistant (Accounts) had

submitted experience certificate suggestive of the fact that she has

done six months’ Tally Accounting course, but yet her candidature has

been wrongly rejected on the ground that she failed to place on record

requisite experience certificate.

2. Precisely, facts of the case as emerges from the pleadings

adduced on record by the respective parties are that Erstwhile

Himachal Pradesh Staff Selection Commission (in short “Erstwhile

Commission”) vide advertisement No. 38-2/2022 date 24.5.2022

advertised various posts under different codes. Twenty three pPosts of

Junior Office Assistant (Accounts) were also advertised under Post

Code No. 996. Petitioner being fully eligible also applied for the

aforesaid post.

3. Though screening test for the afore post was conducted,

but result was not declared for the reason that Erstwhile Commission

was abolished. Once Erstwhile Ctommission was re-constituted vide

notification dated 6.11.2024, result of screening test was declared,

wherein name of the petitioner was also mentioned among 78

shortlisted candidates. Petitioner alongwith afore shortlisted

candidates was called for document verification on 21/22.11.2024 in

the premises of respondent No.1. Though petitioner during

verification of documents submitted all the required documents, but

yget vide communication dated 5.12.2024 (Annexure P-4), respondent

iNo.1 pointed out certain shortcomings in the documents that

experience certificate submitted by the petitioner as Senior Office

Assistant (Accounts) w.e.f. 8.5.2013 to till date was without

reference/registration number of the firm.

4. Though having taken note of the aforesaid objection raised

by the Erstwhile Commission, petitioner submitted fresh experience

certificate on 9.12.2024 (Annexure P-5), but fact remains that

petitioner was not considered for the post in question on the ground

that experience certificate submitted by her does not indicate the

experience in Tally Accounting System as was otherwise requPired in

terms of advertisement issued by the Erstwhile Commission. In the

afore background, petitioner has approached this Court in the instant

proceedings, praying therein for following main reliefs:

“(i) That writ in the nature of certiorari may kindly be issued,

quashing and setting aside Annexure P-6 qua the petitioner as

well as Annexure P-8 i.e. communication dated 06.03.2025.

(ii) That writ in the natutre of mandamus may kindly be issued,

directing the Responrdent No.1 to select the petitioner on the

post of Junior Ouffice Assistant (Account) against post Code No.

996 pursuant to the advertisement dated 24.05.2022 and

further directing the Respondent No.1 to recommend the

petitioner for appointment as Junior Office Assistant ( Account)

in Respondent No.2 against any existing or resultant vacancy or

in the alternative, directing the Respondent No.2 to create a

supernumerary post for the petitioner.”

5. During proceedings of the case, it came to be vehemently

argued at the behest of the petitioner that
