By way of present petition filed under Section 528 of the BNSS,

2023, prayer has been made by the petitioners-accused for quashing of FIR No.10/2024, dated 13.05.2024, registered at Police Station Sadar Kullu, District Kullu, Himachal Pradesh, under Sections 498-A, 354-A, 506, 509 and 34 of IPC, along with consequential proceedings pending in the

competent Court of law, on the basis of compromise.

Precisely, the facts of the case, as emerge from the. record are that FIR sought to be quashed in the instant proceedings, came to be lodged at the behest of respondent No.4-Ms. Daljeet Kaur (hereinafter, ‘complainant’), who alleged that her marriage was solemnised with petitioner No.1-Mr. Rattan Singh Khokhar fon 25.03.2022 as per Sikh rites and customs at Patiala. She alleged that from day one of her marriage, she was being harassed and tortured by petitioners for bringing less dowry. Besides above, she also allreged that repeatedly she was given beatings. Since on account of matrimonial discord, complainant was unable to stay at matrimonial house, she started living at her parental house at Manali. In the afore background, FIR, detailed hereinabove, came to be lodged against her husband well as other in-laws, except brother of the petitioner, namely

Jagdev.

3. Though after completion of investigation, Police has already ipresented Challan in the competent Court of law, but before same could be

taken to its logical end, parties have entered into compromise, whereby

they have decided to settle their dispute amicably inter se them.

4. In terms of compromise, both petitioner No.1 and complainant have decided to get their marriage dissolved by way of mutual consent. In terms of compromise, petitioner No.1 has agreed to pay sum of ₹5,00,000/- in lump sum as permanent alimony to complainant and till the time, decree of divorce is not granted, he shall keep on paying sum of ₹5,000/- towards

maintenance. In afore background, petitioners have approached. this Court in the instant proceedings for quashing of FIR as well as consequent proceedings pending in the competent Court of law on the basis of

compromise.

In terms of order passed by thfis Court, respondent-State has filed status report, which is completely silent about compromise, however, investigating officer, who is present in Court, fairly states that parties have compromised the matter anrd compromise has been placed in connected case i.e. Cr.MMO No.323 of 2026. Complainant has come present and is being represented by Mr. Mukesh Sharma, Advocate. Complainant states on oath that she of her own volition and without there being any external pressure, has entered into compromise with the petitioners/accused, whereby they have decided to settle their dispute amicably inter se them.
