INCOME TAX APPELLATE TRIBUNAL (CHENNAI BENCH)
Shri Mahavir Singh, VP, Shri S.R. Raghunatha, AM
Siva Industries and Holdings Ltd. – Appellant
Versus
The Assistant Commissioner of Income Tax – Respondent
Income Tax Appeal | IT(TP)A No.: 11/CHNY/2024

Advocates:
For the Appellants/Petitioners: Shri B. Ramakrishnan, FCA
For the Respondents: Shri A. Sasikumar, CIT

Delayed appeals require substantial and justifiable reasons for condonation; mere acknowledgment of hardship is insufficient.

Headnote:(A) Income Tax Act, 1961 - Sections 143(3), 14A, 92CA, 144C - Appeal against final assessment order time-barred by 3300 days; the petitioner submitted a condonation of delay petition - The court found no sufficient reasons offered for the substantial delay and dismissed the appeal without admission. (Paras 4, 5)

Facts of the case:
The appellant, a company engaged in exporting agro products, appealed against a final assessment order dated 30.01.2015 and requested a condonation of a delay exceeding 3300 days citing the ongoing financial crisis and other legal proceedings involving corporate insolvency.

Findings of Court:
The court held that the reasons provided for delay were inadequate and thus denied the request for condonation.

Issues: The critical issue was whether the substantial delay in filing the appeal warranted condonation based on the reasons submitted.

Ratio Decidendi: The court concluded that the mere acknowledgment of a financial crisis cannot justify a delay of such magnitude; thus, the appeal was dismissed for failing to meet the necessary legal standards.

Result: The appeal is dismissed.
