JUDGMENT :

R. Mukhopadhyay, J.

1. Heard Mr. Bibhash Sinha, learned counsel for the appellant and Mr. Akash Bhushan, learned counsel appearing for the respondent.

2. This appeal is directed against the judgment and decree dated 05.06.2023 (decree signed on 16.06.2023) passed by Sri Alok Kumar Dubey, learned Principal Judge, Family Court, Bokaro in Original Suit No. 63 of 2021 whereby and whereunder the Suit preferred by the respondent under Section 9 of the Hindu Marriage Act, 1955 has been allowed and the appellant has been directed to join the company of his wife and to lead conjugal life and also to perform his marital duty/obligation within one month from the date of the order.

3. For the sake of convenience, both the parties are referred to in this judgment as per their status before the learned trial court.

4. The petitioner/wife (respondent herein) had instituted a Suit under Section 9 of the Hindu Marriage Act 1955 for restitution of conjugal rights with the respondent/husband (appellant herein) in which it has been stated that the marriage of the petitioner was solemnized with the respondent on 02.03.2019 as per Hindu rites and customs at Bokaro and after marriage the petitioner
