Learned APP Mr. Ravi Prakash is present on behalf of the state.
Pursuant to the previous order, a report was called for from the
Secretary, District Legal Services Authority, Giridih and the said report of
the Secretary, District Legal Services Authority, Giridih is kept at flag A.
From perusal of the report, it is found that the sole appellant Sukhdeo
Marandi had died 5 years ago as per the report submitted by the officer in-
charge of Bengabad police station and the Para Legal Volunteer on the basis
of the information given by Smt. Fulmani Murmu (appellant’s wife) and the
local Mukihiya Smt. Anita Kumari. The letter of PLV deputed at Legal
Services Centre in the block office of Bengabad in the district of Giridih is
also enclosed with the report in addition to the report of the officer in-
charge of Bengabad police station and also the death certificate given by the
Mukhiya Smt. Anita Kumari of panchayat Golgo, parkhand - Bengabad
district Giridih.
In view of the aforesaid report, the learned APP appearing on behalf
of the State submitted that since the appellant has died 5 years ago as per
the report received from the Secretary, District Legal Services Authority,
Giridih based on the report of Mukhiya and officer in-charge and the Para
Legal Volunteer and no close relative has come forward to continue with
this appeal, let this appeal be abated as per the provisions of law.
Having taken into consideration the aforesaid submission and the
report, it is found that the sole appellant Sukhdeo Marandi has died 5 years
ago and no close relative / near relative has come forward to continue with
this appeal and therefore by virtue of operation of law, this appeal gets
abated.
Accordingly this appeal is disposed of as abated.
