CORAM:

HON’BLE MR. JUSTICE RAJESH KUMAR

For the Petitioner

: Mr. Vijay Kumar Roy, Adv.

For the State

: Mr. Rakesh Ranjan, A.P.P.

....

06/14.02.2023

The applicant who is in custody since 02.06.2021 has approached this

Court for grant of regular bail in connection with S.T. No.32/2022 arising out of

Dumri P.S. Case No.45/2021, registered for the offence under Section 302 of IPC

and Section 3/4 of the Prevention of Witch (Daain) Practices Act.

The applicant is an accused of committing murder.

It has been submitted by learned counsel for the applicant(s) that

complete set of F.I.R. alongwith its enclosure have been annexed with this bail

application and there is no suppression on his part.

Innocence has been claimed and undertaking has been given for

participation in the trial. It has been submitted by learned counsel for the applicant

that charge has been farmed on 04.03.2022 but till date not a single witness has

been examined. Further, the allegation does not match with the injury and the entire

is false and he has been implicated due to neighbourhood dispute. On above basis,

prayer for bail has been made.

Learned A.P.P. has opposed the prayer for bail of the applicant and

submitted that there is eye-witness to the incident and further incriminating articles

has been recovered from the house of this applicant.

Considering the materials available on record, I am not inclined to

enlarge the applicant on bail, at this stage. Accordingly prayer for bail of the

applicant stands rejected.

However, the trial court is directed to expedite the trial and conclude the

same within six months from the date of receipt/production of copy of this order.

(Rajesh Kumar, J.)
