02/ 11.12.2025 By filing this writ petition, the petitioner has prayed for the following reliefs:-
“I. To issue an appropriate writ(s)/ order(s)/
direction(s) commanding and directing the Respondent-Jharkhand Public Service Commission, Ranchi to forthwith furnish to the Petitioner his individual marks obtained in each paper of the Jharkhand Combined Civil Services Examination-2023, Preliminary Test and Mains (Written) Examination conducted pursuant to Advertisement No.01/2024, which is otherwise available to all the other candidates who have appeared in the said examination, the same has not been disclosed to the Petitioner even after the Publication of the Final Merit List despite there being a dedicated portal under the heading for “Download your marks” available on the official website of JPSC being https://www.jpsc.gov.in/. The non-disclosure of the marks obtained by the Petitioner by the JPSC is highly discriminatory, arbitrary, illegal and in violation of the Article 14 to the Constitution of India .
AND II. Further be pleased to supply to the Petitioner the copy of his evaluated answer-scripts of all the papers of the said examination, within such time as may be stipulated by this Hon’ble Court; and to hold and declare that the Petitioner is legally entitled to receive such information under the provisions of the Right to Information Act , 2005 as well as under Articles 14, 19(1)(a), and 21 of the Constitution of India .
AND/OR III. Further be pleased to direct the respondents to keep one post vacant for the petitioner subject to final outcome of the instant Writ Application.”
2. Heard learned senior counsel representing the petitioner and learned counsel representing the respondents.
3. It is the grievance of the petitioner that the respondents are not furnishing the individual mark of the petitioner, which he has obtained in each paper of the Jharkhand Combined Civil Services Examination-2023, Preliminary Test and Mains (Written) Examination conducted pursuant to Advertisement No.01/2024. Further prayer has been made to hold and direct that the petitioner is entitled for the aforesaid relief under the Right to Information Act , 2005.
4. From the prayer itself, it is evident that the petitioner has got alternative remedy and as per the petitioner’s counsel, the petitioner has already availed the same by filing application under follow the provisions of the said Statute. Thus, liberty is reserved with the petitioner to take recourse of the remedy under Right to Information Act , 2005.
5. With the aforesaid observation, this writ petition stands disposed of (ANANDA SEN, J.)
