1. It has repeatedly come to the notice of this Court that staff deputed in the filing section are not scrutinizing the documents properly. Like in the instant case, the counter affidavit though has been filed on behalf of the Additional Chief Secretary, Department of Health, Medical Education & Family Welfare, Government of Jharkhand, however, the page numbers of the annexures appended with the counter affidavit are not found to be mentioned in the index and yet the counter affidavit has been placed for our perusal.

The Registrar (Judicial) is directed to hold a thorough inquiry as to why there are such repeated lapses and accordingly fix responsibility henceforth to ensure that all the documents that are filed in the Registry are properly scrutinized and verified and only thereafter placed before the Court. No affidavit irrespective of whether it is counter affidavit, supplementary affidavit etc. shall be accepted by the Registry unless it is not properly indexed and paged and in addition thereto the documents accompanying the affidavit are clearly legible.
3. Looking to the seriousness of issue involved in this case, we appoint Mrs. Prerna Jhunjhunwala as the Amicus Curiae.
4. The Member Secretary, Jharkhand State Legal Services Authority is directed to pay a sum of Rs.3,000/- per effective hearing to the learned Amicus Curiae.
5. On 20th November, 2025, this Court took cognizance of this case suo motu based on the news item regarding “ज़िला अस्पतालों में
ट्रॉमा सेंटर बनाने की योजना कागजो में
ससमटी”, published on 20th November, 2025 in Prabhat Khabar newspaper.
6. Accordingly, notices were issued and the respondents were directed to file a counter affidavit.
7. In compliance to the aforesaid direction, the Additional Chief Secretary, Department of Health, Medical Education & Family Welfare, Government of Jharkhand has filed his affidavit, wherein it is stated that at present altogether 18 Trauma Centres are fully functional with adequate facilities, having deputation of required medical officers and para medical staff in different districts of Jharkhand. In support of the said contention, the respondent has appended a communication dated 27th November, 2025 along with the said counter affidavit.
8. Pursuant to the aforesaid communication, a detailed report has been annexed as Annexure-B, which reads as under:

9. In addition thereto, it has been averred that as far as in the districts where Trauma Centre is not functional, Trauma Care facilities have been provided through the concerned Sadar Hospitals with adequate medical facilities.
10. Lastly, it has been averred that for such of these hospitals, the instructions have been issued to make alternate arrangement to make the Trauma Centres functional with adequate medical facilities at Sadar Hospitals.
11. In order to check the correctness and veracity of the said statement, we deem it appropriate to direct all the Secretaries of the District Legal Services Authority to inspect the Trauma Centres/Sadar Hospitals, who after visiting such Centres shall submit a report with regard to not only the deployment of staff but also regarding the infrastructure and availability of medicines and machines etc.
12. Let such report be submitted within four weeks.
