2. The petitioner is apprehending his arrest in connection with Birni P.S. Case No.209 of 2025, registered for the offence under Sections 75, 352 and 351(2) of the BNS, 2023 and Section 66(E) and 67(a) of I.T. Act, 2000, pending in the Court of the learned Additional Sessions Judge-IInd cum
Special Judge, Cyber Crime at Giridih.

Mr. Rajendra Krishna, learned counsel appearing for the petitioner submits that in the FIR, the allegation is made that in the year 2016 the petitioner has made intimate video of the informant and thereafter further allegation is made of posting the said video on social media. He further submits that the said mischief was done by one Raghunandan Rai. He then submits that prior to sending of the said video, it was also sent to other persons, which has come into the knowledge of the petitioner and the
petitioner has informed the Cyber Police Station about the said creation by way of Annexure-2 Series. He next submits that the investigation is going on and the police have also issued notice upon the said Raghunandan Rai. He also submits that the petitioner is a student and he is studying B. Pharma in Rajiv Gandhi Proudyogiki Vishwavidyalya, Bhopal. To buttress this argument, he refers to enrollment form contained at page 37 of this application. On these grounds, he submits that this anticipatory bail application may kindly be allowed.
4. Ms. Kumari Rashmi, learned counsel appearing for the State opposed the prayer and submits that the allegations are there of putting intimate video/photograph of the informant on social media.
5. Mr. B.M. Tripathi, learned senior counsel appearing for the informant vehemently opposed the prayer of anticipatory bail and submits that the said photograph was initially made by the petitioner, which was made viral and pursuant to the said incident, marital life of the informant is jeopardized condition as she has been thrown out of the matrimonial house.

In view of the above submissions of the learned counsel for the parties and looking into the contents of the FIR, it transpires that the allegation is made of making intimate video of the informant and thereafter it was posted on the social media. The marriage of the informant is solemnized with another person. Annexure-2 Series are the documents which suggest that the petitioner has made application to the concerned police station and informed the police about making the said video viral and pursuant to that the police have issued notice upon one Raghunandan Rai. In course of the arguments, it has been pointed out that the said Raghunandan Rai is happened to be relative of this petitioner and they are in inimical terms. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.
7. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the li
