1. The instant application has been filed under Sections 483 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of bail in connection with Harla P.S. Case No.106 of 2024 (S.T. No. 58 of 2025) registered under Sections 103(1), 238, 3(5) of the B.N.S. pending in the court of learned Additional Sessions Judge-IV, Bokaro.

2. It has been contended on behalf of the petitioner that it is a case where the prosecution has implicated the present petitioner even though the dead body has not been found inside the house of the petitioner, rather the dead body is found near pond dam.

3. Further contention has been made that the implication of the present petitioner is only on surmises and conjecture having no cogent evidence and neither the viscera report has been collected by the Investigating Officer.

5. Learned counsel for the petitioner therefore has submitted that it is a fit case for release of the present petitioner on bail.

6. While on the other hand, the learned Additional Public Prosecutor appearing for the opposite party-State has seriously opposed the prayer for grant of bail.

7. It has been submitted by referring to the case diary that the present petitioner and his wife, after having quarrel in the midnight, has gone out from the house together and thereafter the dead body was found in the road.

8. Therefore, the submission has been made that there is cogent evidence of the complicity of the present petitioner in commission of crime.

9. This Court has heard the learned counsel for the parties, gone through the FIR and the case diary which has been called for by this Court vide order dated 05.01.2026.

It is evident from the material available in the case diary that it is a case based upon no eye-witness and the implication of the present petitioner is based upon the fact that the petitioner and the deceased (wife of the petitioner) have gone out of house after having quarrel in the midnight, and thereafter, the dead body was found near the pond dam.

This Court, after perused the case diary and also taking into consideration that the petitioner is lying in custody since 04.11.2024 and further the charge has been framed on 17.03.2025, yet no witness has been examined, therefore is of the view that the present application deserves to be allowed.

12. Accordingly, the instant bail application stands allowed.

In consequence thereof, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Bokaro in connection with Harla P.S. Case No.106 of 2024 (S.T. No. 58 of 2025) with the condition that the petitioner shall co-operate in the trial and shall not absent himself on the date fixed without any cogent cause. In failure, the learned trial court is at liberty to take appropriate steps in accordance with law so that the trial be not hindered.
