2. It is submitted that I.A. No. 2361 of 2026 has been filed by the Appellant No.2 and Appellant No.3, namely Krishna Ram and Sanjeet Ram @ Horo Ram for suspension of sentence and grant of bail during pendency of this appeal.

3. Learned counsel for the appellant has pointed out that another Interlocutory Application, being I.A. No. 2395 of 2026 has been filed on behalf of both the sides by way of Joint compromise.

4. This Criminal Appeal has been filed on behalf of the appellants challenging the judgment of conviction and sentence dated 21.02.2025 and 25.02.2025, passed by Shri Rakesh Chandra, learned District & Additional Sessions Judge-III, Koderma in Sessions Trial No.199 of 2021, arising out of Jainagar P.S. Case No. 55 of 2020, by which the Appellant No.2 and Appellant No.3, namely Krishna Ram and Sanjeet Ram @ Horo Ram have been convicted for the offence under Section 307 of I.P.C. and sentenced to undergo R.I. for Five (05) years and to pay the fine of Rs. 5,000/-.

5. I.A. No. 2361 of 2026 has been filed on behalf of the Appellant No.2 and Appellant No.3, namely Krishna Ram and Sanjeet Ram @ Horo Ram for suspension of sentence and grant of bail.

Learned counsel for the appellant has submitted that earlier prayer for bail of Appellant No. 2 and Appellant No.3, namely Krishna Ram and Sanjeet Ram @ Horo Ram respectively, has been rejected vide order dated 14.10.2025, whereas bail was granted to Appellant No.1, namely Laxman Ram vide order dated

14.10.2025.

It is submitted that both sides are co-

villagers and they have entered into compromise and for which they have filed a joint compromise petition vide I.A. No. 2395 of 2026 and the matter has been compromised between the parties and there is no dispute between the parties.

It is submitted that the Appellant No.2 is in judicial custody since 21.02.2025 and during trial he has remained in custody for about Two (02) months and Appellant No.3 is in judicial custody since 21.02.2025 and during trial he has remained in custody for about One month as mentioned in the impugned judgment at Para 3 and 4. Thus, the Appellant No. 2 and Appellant No.3, namely Krishna Ram and Sanjeet Ram @ Horo Ram respectively are in custody for more than one year and earlier they were also in custody for some period and hence the Appellant No. 2 and Appellant No.3 may be granted bail.

7. Learned counsel for the State has raised no objection.

8. Learned counsel for the Respondent No.2 has raised no objection and submitted that the parties have compromised the matter and there is no dispute between the parties.

9. From the statement of the parties, it appears that the case has been compromised and both the parties have filed joint compromise petition dated

02.02.2026 vide I.A. No. 2395 of 2026.

10. Perused the record of this case and considered the submission of both sides.

11. Considering the compromise between the parties and on the facts and in the circumstances of this case, the sentence of the Appellant No. 2 and Appellant No.3, is suspended during pendency of this appeal and Appellant No. 2 and Appellant No.3, namely Krishna Ram and Sanjeet Ram @ Horo Ram are directed to be released on bail, on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen thousand) with two sureties of the like amount each in connection with Sessions Trial No. 199 of 2021, to the satisfaction of Shri Rakesh Chandra, learned District & Additional Sessions Judge-III, Koderma /or his Successor Court
