2. The present bail application has been filed on behalf of the petitioner for grant of regular bail, who is in custody in connection with Chirkunda P.S. Case No. 84 of 2020, instituted for the offence under Sections 120B, 406, 407, 409, 420, 464, 467, 468, 470, 471/34 of I.P.C., now pending in the Court of Ms. Arti Mala, learned Chief Judicial Magistrate, Dhanbad.

As per F.I.R., the petitioner is alleged to have cheated the Informant for a sum of Rs.14,50,000/- (Rupees Fourteen lakh fifty thousand only) in the name of supply of articles which were never supplied. During the course of argument, learned counsel for the petitioner has submitted that the petitioner is ready to return the entire amount in two-three months and for the present, on the instruction taken from the Pairavikar of the petitioner, the petitioner is ready to pay Rs.7,25,000/- (Seven lakh Twenty Five thousand) at the time of furnishing bail bonds and he is ready to pay the remaining amount within Two-Three months and this Court may fix any term or condition for grant of bail.

4. Learned counsel for the State has raised objection and has submitted that the petitioner will flee away and as such some stringent conditions may be imposed.

5. Learned counsel for the Informant has submitted that if the petitioner is ready to pay Rs.7,25,000/- (Rupees Seven lakh twenty five thousand) to the O.P. No.2 at the time of furnishing the bail bonds, then he has no objection if bail is granted to the petitioner, but the remaining amount may also be paid.

6. Having heard learned counsel for the parties and from going through the records, it appears that the petitioner is alleged to have cheated the Informant of a sum of Rs.14,50,000/-.

It appears that the petitioner is ready to pay 50% of the amount, i.e. 7,25,000/-, to the Informant and the Learned counsel for the petitioner, after taking instruction from the Pairvikar of the petitioner who is present in the Court today, in presence of the learned A.P.P. and the learned counsel for the Informant, submitted that the petitioner will pay presently the amount of Rs.7,25,000/-.

8. It appears that the petitioner is in custody since 02.08.2025.

Under the circumstances, the petitioner, namely Gopi Velu is directed to be released on bail provisionally for a period of Four (04) months on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen thousand) with two sureties of the like amount each in connection with Chirkunda P.S. Case No. 84 of 2020, to the satisfaction of Ms. Arti Mala, learned Chief Judicial Magistrate, Dhanbad and subject to the condition that the petitioner will deposit Rs.7,25,000/- before the learned Trial Court at the time of furnishing bail bonds and also subject to the condition that one of the bailors must be own relative of the petitioner and the other bailor having movable/immovable property in his/her specific name. The learned Court below shall disburse the said amount of Rs.7,25,000/- to the Informant on filing of an application.

Put up this case on 22.04.2026 and on that date it is expected that the petitioner may furnish a Demand Draft for the remaining amount of Rs.7,25,000/- in the name of the Informant, which may be deposited before the learned Registrar General by filing supplementary affidavit also and the Office of the Registrar General shall keep the same till further of this Court and shall not disburse the same without prior permission of the Court.
