02/21.01.2026: The learned counsel for the petitioner has filed the writ petition seeking the following prayers:-
i) For issuance of a writ(s)/order(s) / direction(s) or a writ in the nature of Mandamus commanding upon the respondents th to extend the benefit of recommendation of 6 Pay Revision Commission to the petitioner and fixation of his salary as per recommendation made by the Department of Finance and give the benefit of salary in PB-II Rs. 9300-34800/- Grade Pay Rs. 4200/- w.e.f 01.01.2006 with all consequential benefit as well as its arrear.
ii) For issuance of a writ(s)/order(s)/direction(s) or a writ in the nature of mandamus commanding upon the respondents to fix the basic pay scale of the petitioner as Rs. 18240 in place of Rs. 14900/- w.e.f. 01.01.2006 and pay the arrear and all other consequential benefit though the Grade pay of 4200 has been given but as per their own recommendation the basic pay of the petitioner has not been rectified as Rs. 18240/- neither the arrear has been given in spite of the issue decided by this Hon’ble Court on 27.11.2025 in W.P.S No.
5897 of 2014 with other analogous cases.
iii) For issuance of a writ(s)/ order(s)/ direction(s) or a writ in the nature of mandamus commanding upon the respondents to consider the case of the petitioner for promotion in Grade- III to which seniority list has been prepared way back on 25.04.2025 but till date the promotion in Grade-III has not been given effect.
2. It is the case of the petitioner that his pay scale has not been correctly fixed and he is entitled to be placed in the pay scale of Rs. 18240/-, but his pay has been fixed in the pay scale of Rs.14900/-.
3. The petitioner also prays for consideration of his promotion in Grade-III as per seniority.
4. Learned counsel for the State submits that if the petitioner files the representation before the respondent no.3, his case will be considered and an appropriate order will be passed, as per law, and if it is found that the petitioner is entitled for any relief, the same will be extended to the petitioner.
5. Considering the submissions of the parties, I direct the petitioner to file a fresh representation within four weeks before the Director School Education and Literacy Department, Government of Jharkhand, MDI Building, Dhurwa, P.O & P.S- Dhurwa, District Ranchi respondent no. 3, on receipt of the said representation, the case of the petitioner will be considered within six weeks and if it is necessary to place the case before any committee or any authority, the same should be placed during the said period.
6. If it is found that the petitioner is entitled for any relief the same be extended to him within 4 weeks thereafter. Further if it found that the petitioner is not entitled, the reasoned order should be communicated to him within the aforesaid period.
7. Accordingly, this writ petition is allowed and disposed of.
