By filing this writ petition, the petitioner has prayed for
the following reliefs:-
“I. For issuance of appropriate writ/writ(s), order/order(s), direction/direction(s) for directing the respondents to determine and pay lawful compensation for the petitioner’s

land appertaining to Mouza Darisai, Village Putru, Thana No.1250, Khata No.21, Plot No.214, already utilized for widening of NH-33 along with statutory interest, within a time-
bound period.
II. For issuance of appropriate writ/writ(s), order/order(s), direction/direction(s) for directing the respondents to pay interest, solatium and statutory benefits on the delayed
compensation.
III. For issuance of appropriate writ/writ(s), order/order(s), direction/direction(s) for restraining the respondents from interfering with the petitioner’s remaining unacquired
land with due process of law.
IV. for issuance of appropriate writ/writ(s), order/order(s), direction/direction(s) for directing the respondents to pass a reasoned and speaking order on petitioner’s pending
representations (Annexure-2 Series).
V. For issuance of appropriate writ/writ(s), order/order(s), direction/direction(s) for award costs of the writ petition in favour of the
petitioner.”
2. Heard learned counsel representing the petitioner and
learned counsel representing the respondents.
3. It is the grievance of the petitioner that his land has been acquired by the National Highway Authority of India (NHAI), without completing lawful acquisition proceedings and without payment of
compensation to him.
4. Considering the aforesaid case of the petitioner and the fact that the land of the petitioner has been acquired by the NHAI, I direct the petitioner to invoke the remedies available under Section

3H of the National Highways Act, 1956, before the appropriate Authority, within a period of four weeks from the date of receipt of
copy of this order.
4.1. If the petitioner files an appropriate application under Section 3H or any other relevant provisions of the National Highways Act, it is expected that the respondents will proceed accordingly as
per the said Act, within the reasonable timeframe.
5. With the aforesaid observation and direction, this writ
petition stands disposed of
