ORDER

1. The petitioner has challenged the complaint filed by the respondent against him, alleging commission of offences under Section 499/500 RPC, which is stated to be pending before the court of learned Judicial Magistrate Ist Class (City Judge), Jammu.

2. As per allegations made in the impugned complaint, the petitioner/accused has made defamatory remarks against the respondent/complainant by addressing a communication to the Chairman, Cantonment Board, Jammu, a copy whereof was obtained by the respondent/complainant from the office of CEO, Cantonment Board. The contents of the alleged defamatory communication have been reproduced in the complaint and the same read as under:-

Aaj ki yeh meeting, jis mein W-2 ke member nain joe iljmaat board par lagaye hain uske baire mein yeh special meeting rakhi gaye hai.
