ORDER

1. Pursuant to order dated 15.10.2025, as being very first order passed in the writ petition upon its institution, this Court came to call upon Mr. Suneel Malhotra, learned Government Advocate appearing on behalf of respondents No.1 to 6 to produce the original record pertaining to e- NIT No.03-DAHK of 2025 dated 08.04.2025 along with production of record of technical evaluation summary of the bid submitted by the petitioner.

2. On next date of hearing 17.10.2025, reply/status report came to be filed on behalf of respondents No.1 to 6.

3. The filing of status report was followed by an order dated

18.10.2025, in terms whereof the consideration of application for interim relief was deferred, keeping in view the fact that the respondents are said to have finalised the rate contract on 15.10.2025 for 22 items, as was stated petitioner.

4. Mr. Rahul Pant, Senior Advocate for the petitioner assisted by Mr. Dhruv Pant, Advocate was to consider an amendment of the writ petition or to file the fresh writ petition for challenging the rate contract.

Pointing out some glaring facts borne out of the status report to the extent that the Concerns allocated with the rate contract do not have the license and GMP (Good Manufacturing Practice) certification, accordingly, this Court came up with a direction to learned counsel for the respondents to ensure relevant record related to the entities having owned the rate contract to be made available before this Court.

6. Today, Mr. Rahul Pant, learned Senior Advocate very pointedly submits that one of the tendered items of Animal Feed Supplements does not require any licensing nor any GMP (Good Manufacturing Practice) certification under the Drugs and Cosmetic Act, 1940 and the rules made thereunder.

7. Mr. Rahul Pant, leaned Senior Advocate invites the attention of this Court that as per the status report, the contract of supply of Animal Feed Supplements for the identified 22 items has been given to concern M/s Medpro Animal Feed Supplements, village Sarore, tehsil Bishnah, district Jammu, J&K.

petitioner would volunteer withdrawal of the writ petition in case the UT Level Purchase Committee, Animal Husbandry Department places on record the GMP (Goods Manufacturing Practice) under the Drugs and Cosmetic Act, 1940 with regard to the Animal Feed Supplements as allocated in the rate contract.

In addition, it is also been pointed out by Mr. Rahul Pant, Senior Advocate for the petitioner that the rate contract allotment exercise is vitiated with serious lapses and in this regard, he refers to the fact that one of the concerns given the annual rate contract for veterinary drugs/medicines(Allopathic) in favour of M/s Minil Laboratories Pvt. Ltd. is possessing no such drugs manufacturing license with respect to drug-Ectoparasites Deltamethrin 12.5mg/ml.

10. Let Dr. Sanjay, Chairman of UTLPC, J&K submit an affidavit with respect to aforesaid two aspects along with supporting document by next date of hearing positively failing which, he shall suffer a direction for personal appearance.
