The petitioner having purchased the subject property

under a registered sale deed dated 9.7.2010 filed a petition

under Section 27(2)(r) of the Karnataka Rent Act, 1999 for

eviction of the respondent herein. The Trial Court dismissed

the petition stating that the petitioner has not proved the jural

relationship of landlord and tenant. Hence, this petition.

The learned counsel for the petitioner submits that

the petitioner having acquired the title over the subject

property under the registered sale deed stepped into the shoes

of erstwhile owner and became the landlord of the petition

schedule premises. Hence, the petition filed under Section

27(2)(r) of the Karnataka Rent Act, 1999 was maintainable.

However, the Trial Court contrary to the evidence on record has

dismissed the petition and the same is not sustainable in law.

The respondent though served with notice has not

appeared in person or through his counsel.

Considered the submission of the learned counsel

for the petitioner.

The petitioner proved that he had acquired the title

over the subject property through the registered sale deed

dated 9.7.2010 marked as Ex.P1, and copies of tax paid

receipt, khatha cert
