The brief facts of the case are that the appellant herein has filed a suit in O.S.No.566/2009 for partition and separate possession and the respondent herein has filed a suit in O.S.No.6785/2008 for declaration and possession. The suit filed by the respondent herein in O.S.No.6785/2008 has been decreed and the suit filed by the appellant herein in O.S.No.566/2009 has been dismissed. Being aggrieved by the same, the appellant herein has filed these appeals.

3. Today, the parties have filed a compromise petition under Order 23 Rule 3 r/w Section 151 of CPC. The parties are present before this Court and signed the compromise petition. They have been identified by their respective counsel. The same is taken on record and the same is extracted below:

At the intervention of this Hon’ble Court and having regard to the relationship between the parties, they have agreed to amicably settle the long pending disputes on the following terms and conditions:

2. The appellant has also agreed to pay in all a sum of Rs.10,00,000/-
