The petitioner has filed this petition under Section 24 of the Code of Civil Procedure, 1908 to transfer the case in M.C.No.37/2023 pending on the file of the Additional Senior Civil Judge and JMFC, Sindagi to the Court of the Senior Civil Judge and JMFC, Shorapur.
2. The learned counsel for the petitioner has submitted his argument that the present petitioner has filed a petition for maintenance under Section 125 of Cr.P.C . before the learned Senior Civil Judge and JMFC, Shorapur in Crl.Misc.No.799/2022. Though the learned Senior Civil Judge and JMFC, Shorapur has passed an interim order to pay the interim maintenance amount of Rs.2,000/- to petitioner and Rs.1,500/- each to the two children of petitioner and respondent, the respondent has not complied the order of the Court. Instead of complying the order of the Court, the respondent has filed divorce petition in M.C.No.37/2023 before the learned Senior Civil Judge and JMFC, Sindagi. The petitioner has no financial capacity to spend litigation expenses and also she is unable to attend the said Court. On all these grounds sought for allowing this petition.
